If parents are not married to one another at the time of the birth of a child then the father may not automatically have parental responsibility for his child/children. Beyond December 2003 a non-married father could acquire parental responsibility if he attended at registration of the child’s birth and signed the birth extract. Otherwise he could acquire parental responsibility by entering into a Parental Responsibility Agreement with the natural mother or by applying to the Court for an order.

In general terms the Court would be inclined to grant parental responsibility to a natural Father, unless there were exceptional circumstances making it contrary to the welfare of the child. Parental responsibility is always desirable as it gives the natural father legal authority and the right to be consulted regarding the children’s religion, education, health and welfare.
