Enforcement

This is a huge topic relevant to both final financial remedy orders, as well as interim orders, for example, for maintenance.

Enforcement orders are also common in Children Act proceedings, specifically Child Arrangement Orders, where a parent fails to comply with an order for contact, or may even refuse to return child after a contact session.

All final Children Act orders carry a warning notice whereby a  fine, an order to carry out a community penalty and/or a brief sentence of imprisonment are all possible consequences.

Breach of an order of the Court is a very serious matter and the Court will come down hard, if there are issues of non-compliance.

For specific advice on how to apply to the court for breach proceedings to deal with the consequences of non-compliance in financial and children act proceedings, please contact us for specific advice.
